2. Content and intellectual property

All articles, photographs, illustrations, graphics, and other content published on the Website (the "Content") are owned by Latino Professionals or its licensors and are protected by copyright, trademark, and other intellectual property laws. "Latino Professionals," "Latino Professionals Magazine," and associated logos are trademarks of Latino Professionals Media Group.

If you believe your copyrighted work has been used on the Website in a way that constitutes infringement, see Section 3 below.

Latino Professionals Media Group respects the intellectual property rights of others and expects users of the Website to do the same. We respond to clear notices of alleged copyright infringement in accordance with the Digital Millennium Copyright Act (17 U.S.C. § 512).

Filing a notice. If you believe material on the Website infringes your copyright, send a written notice to our designated agent that includes:

  • A physical or electronic signature of the person authorized to act on behalf of the copyright owner
  • Identification of the copyrighted work claimed to have been infringed
  • Identification of the material claimed to be infringing, and information reasonably sufficient to let us locate it on the Website (such as the URL)
  • Your name, address, telephone number, and email address
  • A statement that you have a good faith belief that the use is not authorized by the copyright owner, its agent, or the law
  • A statement, made under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf

Designated agent:
Latino Professionals Media Group
Attn: Copyright Agent
Email: copyright@latinoprofessionalsmagazine.com

Counter-notification. If you believe material you posted was removed or disabled by mistake or misidentification, you may send our designated agent a counter-notice containing:

  • Your physical or electronic signature
  • Identification of the material removed and the location where it appeared before removal
  • A statement, under penalty of perjury, that you have a good faith belief the material was removed as a result of mistake or misidentification
  • Your name, address, telephone number, and a statement consenting to the jurisdiction of the federal court in your district (or, if outside the United States, Los Angeles County, California) and that you will accept service of process from the person who filed the original notice

Upon receipt of a valid counter-notice, we may restore the material within the timeframe required by law unless the original complaining party first files a court action seeking to restrain the alleged infringer.

Repeat infringers. We will, in appropriate circumstances, disable or terminate the accounts of users who are determined to be repeat infringers.

4. User submissions

If you submit a story idea, nomination, correction, event listing, career application, guest suggestion, manuscript, or any other material to us ("Submissions"), you grant us a non-exclusive, royalty-free, worldwide license to use, reproduce, and publish that Submission in connection with our editorial and business operations. You represent that you have the right to submit the material and that it does not infringe any third party's rights.

Submitting a Submission does not guarantee coverage, a response, or any form of recognition. Editorial coverage, Series selection, and recognition are determined solely by our editors against published criteria and are never for sale. See our Editorial Standards.

5. Commissioned content

Companies and individuals may commission Partner Profiles, Partner Features, or Series sponsorships at our published rates, as described on the Get Featured and Advertise pages. Every commissioned piece is visibly labeled as such. Commissioning content does not grant any influence over our independent editorial coverage, Series selection, or judgment, which remain governed by our Editorial Standards.

6. Membership and the Latino Professionals Council

Paid membership tiers, when available, grant access to specified digital content and benefits as described at the point of purchase. Membership in the Latino Professionals Council is separate from any paid subscription tier: Council admission is by nomination and committee review only, is never sold, and does not affect editorial coverage in any way.

7. Payments

Paid subscriptions and commissioned content are billed through our third-party payment processor. By making a purchase, you agree to that processor's applicable terms. All sales are subject to the refund or cancellation terms stated at the time of purchase; absent a stated term, fees are non-refundable except as required by law.

The Website may link to third-party websites, including partner organizations, event ticketing platforms, and sources cited in our reporting. We do not control and are not responsible for the content, accuracy, or practices of any third-party website.

9. Disclaimers

The Website and its Content are provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of accuracy, completeness, merchantability, fitness for a particular purpose, or non-infringement. We take editorial accuracy seriously and correct errors when identified — see our Editorial Standards and Contact pages to request a correction — but we do not guarantee that the Website will be uninterrupted, error-free, or secure.

10. Limitation of liability

To the fullest extent permitted by law, Latino Professionals Media Group and its officers, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Website. Our total liability for any claim arising from these Terms or your use of the Website will not exceed the amount you paid us, if any, in the twelve months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless Latino Professionals Media Group from any claims, damages, or expenses (including reasonable legal fees) arising from your violation of these Terms or your misuse of the Website.

12. Governing law

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws principles. Any dispute arising from these Terms or your use of the Website will be brought exclusively in the state or federal courts located in Los Angeles County, California, and you consent to the jurisdiction of those courts.

13. Changes to these Terms

We may update these Terms from time to time. The effective date at the top of this page reflects the most recent revision. Continued use of the Website after a change becomes effective constitutes acceptance of the revised Terms.
